Sex Offender Community Information

The Massachusetts Sex Offender Registry Board is responsible for the registration and classification of sex offenders pursuant to Massachusetts General Laws Chapter 6 Sections 178C through 178P. The Sex Offender Registry Board classifies offenders as follows:

Level 1 - Low risk to re-offend and a degree of dangerousness

Level 2 - Moderate risk to re-offend and a degree of dangerousness

Level 3 - High risk to re-offend and a degree of dangerousness [Attleboro Level 3 Sex Offenders]

The law only permits the public to receive information on sex offenders required to register and have been classified by the Sex Offender Registry Board as a Level 2 [moderate risk] or Level 3 [high risk] offender.

When the Sex Offender Registry Board classifies an individual as a Level 3 Sex Offender the police department is required to perform community notifications.

Pursuant to Massachusetts General Laws Chapter 6 Sections 178C through 178P the police department shall notify organizations in the community that are likely to encounter an offender classified as a Level 3 Sex Offender and notify individual members of the public who are likely to encounter such an offender. Organizations in the community that are likely to encounter Level 3 Sex Offenders include but are not limited to, public and private organizations, areas and establishments which provide services of any type to children, the elderly or other members of the community. 

Community notification shall require that all schools in the community be made aware. The police department may notify other organizations, such as day care centers, youth / recreational programs and organizations providing elder services, as deemed necessary to protect the public safety.

The method of community notification shall include but is not limited to:

Publication of information in the local newspapers/cable television.

Posting the information in publicly accessible areas.

NOTE: Any information provided by either the police or the Board will be limited only to offenders who have been finally classified by the Board as Level 2 or Level 3 offenders or Sexually Violent Predators. The law prohibits the Board and police departments from disseminating any information on a sex offender who has not been finally classified by the Board or who has been finally classified as a Level 1 offender.

Section 178N. Information contained in the sex offender registry shall not be used to commit a crime against a sex offender or to engage in illegal discrimination or harassment of an offender. Any person who uses information disclosed pursuant to the provisions of sections 178C to 178P, inclusive, for such purpose shall be punished by not more than two and one-half years in a house of correction or by a fine of not more than $1,000 or by both such fine and imprisonment.
